These Terms of Service (“Terms”) govern your use of Nearchon’s website, applications, software, and educational services (“Services”).

By using Nearchon, you agree to these Terms.

1. What Nearchon Provides

Nearchon provides educational software designed to help students learn STEM subjects through active problem solving.

Nearchon may:

  • Provide questions and exercises
  • Analyze student solutions
  • Provide hints and feedback
  • Identify potential mistakes or misconceptions
  • Recommend additional practice
  • Generate educational diagrams and visualizations
  • Maintain learning history
  • Provide reports to authorized parents, teachers, or tutors

Nearchon is an educational support tool, not an official grading service, examination authority, or replacement for teachers or professional educators.

2. Your Account

You are responsible for:

  • Providing accurate account information
  • Protecting your password
  • Keeping your account secure
  • Not sharing your account with unauthorized individuals

You must notify us if you believe your account has been compromised.

3. Student Use

Students must use Nearchon for legitimate educational purposes.

Students may not:

  • Attempt to bypass security controls
  • Reverse engineer the service except where legally permitted
  • Abuse or overload the service
  • Attempt to obtain protected answers or system prompts
  • Upload malicious content
  • Impersonate another user
  • Use the service to violate applicable laws or academic-integrity rules

4. Nearchon Does Not Guarantee Correctness

Nearchon’s feedback is generated using software and AI systems and may occasionally be incorrect.

Nearchon is designed to provide educational guidance, but:

Nearchon does not guarantee that every explanation, diagnosis, hint, visualization, or recommendation will be correct.

Students, teachers, tutors, and parents should use appropriate judgment.

Nearchon should not be treated as the sole authority for high-stakes academic, medical, legal, or other professional decisions.

5. Learning Mode and Answer Disclosure

Nearchon’s learning experience is designed to help students reason independently.

Accordingly, Nearchon may intentionally provide hints, questions, or partial guidance rather than directly providing a complete solution.

Nearchon does not guarantee that every interaction will behave perfectly, and users should not attempt to circumvent learning controls.

6. Intellectual Property

The Nearchon software, interface, branding, original educational content, visualizations, documentation, and other materials are owned by Nearchon or its licensors.

You receive a limited, non-exclusive, non-transferable right to use the Services for their intended purpose.

You may not copy, reproduce, distribute, sell, or create derivative products from Nearchon’s proprietary materials without permission.

7. User Content

You retain ownership of content you submit to Nearchon, subject to the rights needed for us to operate the Services.

You grant Nearchon a limited license to host, process, display, and analyze your content as necessary to provide the Services.

For example, when a student uploads a handwritten solution, Nearchon needs permission to process that solution to analyze the student’s reasoning and provide feedback.

8. Feedback

If you provide suggestions, feedback, or ideas about Nearchon, we may use those suggestions to improve the service without owing you compensation, unless otherwise agreed.

9. Parents and Guardians

Where required, a parent or legal guardian must authorize a minor’s use of Nearchon.

Parents are responsible for supervising their child’s use of Nearchon where appropriate.

Parents may contact Nearchon regarding their child’s account and privacy rights using the contact information in the Privacy Policy.

10. Teachers and Tutors

Teachers and tutors are responsible for using Nearchon appropriately with their students.

Nearchon does not independently establish official grades, academic placement, or disciplinary decisions.

Educators remain responsible for their own professional judgments.

11. Schools and Institutions

Institutional users may be subject to additional agreements.

Where an institution controls student information, the parties may enter a data-processing agreement, student-data privacy agreement, or other contractual terms.

12. Subscriptions and Payments

Where paid plans are available:

  • Prices are displayed before purchase.
  • Subscription terms will be disclosed during checkout.
  • Renewal terms will be disclosed before purchase.
  • Applicable taxes may apply.
  • Refund policies will be stated at checkout or in the applicable plan terms.

13. Service Availability

We will make reasonable efforts to keep Nearchon available, but we do not guarantee uninterrupted access.

The service may occasionally be unavailable for:

  • Maintenance
  • Updates
  • Security incidents
  • Infrastructure failures
  • Third-party service outages
  • Events outside our reasonable control

14. Third-Party Services

Nearchon may integrate third-party services.

We are not responsible for the independent privacy practices, availability, or functionality of third-party services except as required by applicable law or contractual obligations.

15. Academic Integrity

Nearchon is designed to support learning rather than facilitate cheating.

Users should follow the rules of their school, teacher, examination board, or educational institution.

Nearchon does not guarantee that use of the product is permitted in a particular assignment or examination.

16. Suspension and Termination

We may suspend or terminate accounts that:

  • Violate these Terms
  • Abuse the service
  • Create security risks
  • Engage in fraudulent activity
  • Use the service unlawfully

Where appropriate, we will provide notice and an opportunity to resolve the issue.

17. Disclaimer

To the maximum extent permitted by law, Nearchon provides the Services on an “as is” and “as available” basis.

We disclaim warranties to the extent legally permitted, including warranties relating to uninterrupted availability or complete accuracy.

Nothing in these Terms limits rights that cannot legally be excluded.

18. Limitation of Liability

To the maximum extent permitted by law, Nearchon will not be responsible for indirect, incidental, special, consequential, or punitive damages arising from use of the Services.

Any additional limitations required by applicable law will apply.

19. Changes to These Terms

We may update these Terms as Nearchon evolves.

Material changes will be communicated through appropriate means.

Continued use of the Services after the effective date of updated Terms constitutes acceptance to the extent permitted by law.
